Your placement of an order at the Babies.co.nz Store constitutes your agreement that these policies apply to the order, so be certain you understand them before you place your order.

About these Terms and Conditions
In these terms and conditions "we" and "us" mean Unicare Nz Ltd Limited of 62 Kerwyn Ave, East Tamaki Auckland 2013, and "you" means you the customer. Words spelt with initial capital letters are defined terms which, for your ease of reference, are set out at the end of the terms and conditions. These terms and conditions together with your Order constitute the entire Contract between us and you for the supply of Products. No other terms and conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.
New Zealand Sales Only
We only sell and ship Products within New Zealand. We will not make deliveries outside New Zealand.
Sales to End Users Only
The Babies.co.nz Online Store sells and ships products to end user customers only. For wholesale enquiries please contact us on +64 9 274 3099.
Equally, any competitions run on a Babies NZ Email Marketing Toolslanding page are in no way sponsored, endorsed or administered by, or associated with Email Marketing Tools. By participating you hereby release and hold harmless Email Marketing Toolsfrom any and all liability associated with this promotion.
Entrants are providing information to Babies NZ and not to Facebook, Instagram or Email Marketing Tools.
Please read these competition rules carefully. If you enter one of our competitions, we will assume that you have read these rules and that you agree to them.
To enter a competition you must be:
(a) NZ resident; and
(b) have a specified New Zealand address for delivery
No responsibility can be accepted for entries that are not received for any reason.
The winner will be selected at random by a non-biased party. For competitions that are a game of skill: entrants are required to submit a creative entry. Winners will be selected by a panel of representatives of the Promoter who, at their discretion, will select the best answer/s based upon originality, creativity, and adherence to any specified word limit. Chance plays no part in determining the winners. The Promoter's decision in relation to any aspect of the competition is final and binding on every entrant. No correspondence will be entered into.
The closing date is as specified in each competition, and Babies NZ reserves the right to amend the competition end date at any time.
If you win a competition, we will notify you via email, Facebook Messenger or phone. If we cannot contact you or you do not respond within one week, we reserve the right to offer the prize to another competition entrant.
The prize is not transferable to another person.
No prize or part of a prize is exchangeable for cash, refunds or services.
If an advertised prize is not available, we reserve the right to offer an alternative prize.
Babies NZ reserves the right to amend these rules at any time. We may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.

For order status information or other assistance with an order you have already placed with the Babies.co.nz Store, please contact our Customer Service desk on Support on 0800 DRY KIDS (0800 379 543) between the hours of 9.00am and 5.00pm Monday to Friday.
Placing Your Order
You may place an Order by either:
1 Filling in the Order Form on the Babies.co.nz Store Web Site and Clicking the "Submit My Order" button (this facility is available 24 hours a day, 7 days a week);
2 Telephoning us on 09 274 3099 between 9.00am and 4.30pm Monday to Friday, excluding New Zealand public holidays.
3 If you wish to pay by bank transfer you may place your Order on our website. We will reserve the stock for 7 days only.
4 When you place your Order, we will issue you with a Web Order Number. We will do this by email, so it’s important that you fill in your correct details.
5 By placing an Order, you make an offer to us to purchase the Products you have selected on these terms and conditions. We may or may not accept your offer at our discretion. If we accept your Order, we will notify you of our acceptance by issuing an Order Confirmation. We will send your Order Confirmation to you by email. The Order Confirmation will be effective on sending.
6 If we cannot accept your Order we will contact you by telephone or email.
7 Information contained on the Babies.co.nz Store Web Site constitutes an invitation to treat. No such information constitutes an offer by us to supply any Products.
Supply of Your Products
1 Subject to these terms and conditions, we will supply to you the Products indicated on your Order Confirmation.
2 When your Order has been processed, we will process and send out your order.

Goods & Service Tax (GST)
Babies.co.nz Store purchases will include GST. If you phone in your order, the Babies.co.nz Specialist will provide the final dollar total of your order including GST and any applicable shipping charges at the time you place your order. The invoice Babies.co.nz emails or posts to you will include GST.
The Babies.co.nz Store endeavor's to offer you competitive prices on current products. We reserve the right to change prices for products displayed at any time. Should Babies.co.nz reduce its price on any product you have purchased (except promotional / special / discount / refurbished products) within 7 calendar days of receiving your goods, you may contact us on 09 274 3099 to request a credit of the difference between the price you were charged and the current selling price. To receive the credit you must contact us within 7 calendar days of receiving your goods.
Estimated ship time is the length of time it will take us to validate your credit card, assemble the right products and package your order. Delivery time is the length of time it will take for the package to travel from our warehouse to your shipping address. We make every effort to ship your product according to the estimated ship times provided. The estimated ship times are in business days (Monday through Friday) excluding New Zealand public holidays. Estimated ship times will begin the following business day for orders placed and credit cleared after 3.00 p.m.
Although every effort is made to ship your order according to the estimated ship times provided, estimated ship times may change due to changes in supply. If the estimated ship time changes, we will contact you via email and provide a revised estimated ship time estimate.
We encourage you to contact us on 09 274 3099 for order status information, given the popularity of some products, We may restrict the number of such items that you may purchase. Any product limit restrictions will be posted on the Babies.co.nz web site. This information is subject to change.
Delivery of Your Products
We offers free nationwide shipping for orders over $200 (price including GST, excluding rural deliveries). Otherwise, shipping charges would apply. We will not deliver any Products to any address outside New Zealand. The estimated shipment date on your order is based on product availability, payment processing time and warehouse processing time and does not include transit time. Payment processing will not begin until we receive all the information we need and full payment (or a full authorization, in the case of credit card orders). Orders placed on the weekend or on a New Zealand public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding New Zealand public holidays.
Unless otherwise agreed by us, we will deliver your Products to the ship to address indicated on your Order Confirmation. If no-one is available to take delivery of your Products, our carrier may leave a card requesting you to telephone and arrange a suitable time and date for delivery.
We will use our reasonable endeavors to deliver your Products to you within 2-5 working days of the date of issue of your Order Confirmation, however, we do not guarantee that we will deliver within this time frame. If we are unable to deliver your Products to you within 30 days of the date of issue of your Order Confirmation, you will have the option to cancel your Order.
Subject to Condition (see below), if you discover what you believe is a product defect for any products purchased from the Babies.co.nz, please contact Us on 0800-DRY KIDS (0800 379 543). Such a defect, if any, is covered under the terms of your product's warranty.
All products (excluding mattresses, baby clothing, etc) carry a full one (1) year manufacturer’s warranty as testimony to the quality and longevity of the range. This warranty excludes general wear & tear and damage caused, by the product not being used in accordance with its instructions or the care instructions.
During this guarantee period Unicare Nz Limited will replace or repair any defective part. In the event of a product being replaced, as a whole unit or part thereof during the guarantee period, the guarantee on the replacement will expire one (1) year from the original purchase date.
This guarantee excludes accidental damage, misuse and or improper transporting and handling. The warranty is void if the original product has been altered in design or colour in anyway. Please refer to the warranty information and other supporting documentation that came with your product.
Proof of Purchase
We will send an Order Confirmation via email if you have included an email address with your order. If you have not included an email address, you will receive an Order Confirmation with your parcel.
Other Terms and Conditions
Babies.co.nz is not responsible for typographic errors. If a product is listed at an incorrect price or incorrect description due to typographical error or error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for product or service listed at the incorrect price. Unicare Nz Ltd. has the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.
We reserve the right to change the terms and conditions of sale at the Babies.co.nz Store at any time. No Unicare Nz ltd employee or agent has the authority to vary any of the Babies.co.nz Store's policies or the terms and conditions governing any sale.
All our products carry a one-year Limited Warranty against defects in materials and workmanship. You may review a copy of the Limited Warranty on new products, including its limitations and exclusions, before you purchase, by going to the end of this document.
You may cancel your order or parts of it before the order is dispatched by babies.co.nz. However, once the order is dispatched for delivery you are unable to cancel the order. Please note that we do not offer refunds if you have changed your mind about a purchase. Please note that we will recover the credit card & processing fee (minimum charge of NZ$10.00) before applying the refund back to your card.
Babies.co.nz also reserves the right to cancel your order if:
- You have provided an un-authorized credit card
- We are unable to process payment on the credit card provided
- You provide invalid personal details
- The product has become unavailable
- You have exceeded the allowed time frame for your layby and have not requested an extension
- You have not made payments toward a direct credit or a layby order.
- We will notify you via email once your order is cancelled.
Please choose goods carefully as you are not entitled to a refund if you simply change your mind or make a wrong decision.It is your responsibility to ensure that the goods purchased will fit into your house.
Due to New Zealand’s strict hygiene regulations, we do not return or exchange mattresses, clothing, disposable products (open packets), pillows and bedding.
If you decide to return an item (other than faulty goods), a 25% of the value of the item is deducted as a re-stocking fee.
Babies.co.nz reserve all rights to deem a claim for return worthy of refund or otherwise.
Goods purchased on www.babies.co.nz may be returned for an exchange with a receipt within 10 working days of purchase in their original packaging and condition. Goods must be in unused, unwashed condition in original packaging. We ask that you choose carefully and check sizing, colors before ordering. Please do not break open packaging that is non-reseal-able if you wish for an exchange or credit on your account with Babies.co.nz.
Please choose sale items carefully as they are non refundable and non exchangeable.
Please note that we cannot refund postage and packaging or any other charges incurred from a third party.
Please note if you have been issued with a credit, it is only valid for one year from the date of issue.
We are unable to replace or refund items damaged through improper laundering, so please follow our washing instructions carefully.
Please note that products that have been marked as "Seconds / Factory Seconds", "Clearance" are none refundable and cannot be exchanged.
Please note that we do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully.If goods are faulty we will meet our obligations under the Consumer Guarantees Act to provide a remedy.
We want you to be happy, please call us if you need advice.
These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the Products and performance of the Services and there are no warranties, conditions or other terms that are binding on us except as expressly stated in the Contract. Subject to Condition below, any warranty, condition or other term concerning the Products or Services which might otherwise be implied into or incorporated in the Contract by statute, common law or otherwise (including without limitation any implied term as to quality or fitness for purpose) is hereby expressly excluded.
Nothing in the Contract excludes, restricts or modifies any condition, warranty, right or liability implied into this Contract (including any condition, warranty, right or liability imposed by the Consumer Guarantees Act 1993) where to do so is illegal or would render any provision of this Contract void.
Nothing in the Contract shall limit or exclude our liability for death or personal injury caused by our negligence.
Subject to Conditions above, we will not be liable under the Contract for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability under the Contract whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
If you are a consumer (as defined in the Consumer Guarantees Act 1993):
(a) and you are acquiring or holding yourself out as acquiring the Products or Services for a business purpose, the Consumer Guarantees Act 1993 will not apply; and
(b) we do not guarantee that repair facilities and spare parts for the Products will be available.
By placing your Order, you agree that we may store, process and use data collected from your Order Form for the purposes of processing your Order. If you so indicate on the appropriate section of your Order Form, by placing your Order you also agree that we may transfer such data, other than credit card details, to other companies in the Unicare Nz group of companies in order to provide you with information from time to time on other Babies.co.nz products and services that may be of interest to you. If you do not agree to our transferring such data to other companies in the Unicare Nz group of companies in order to provide you with information on other Babies.co.nz products and services, you should indicate your non-agreement on the appropriate section of your Order Form. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request. We reserve the right to charge a fee for certain requests.
Mobile Terms of Service - Babies NZ

The Babies NZ mobile message service (the "Service") is operated by Babies NZ (“Babies NZ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Babies NZ’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Babies NZ through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Babies NZ. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Babies NZ mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.
The Contract will be governed by the law of New Zealand. Both we and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New Zealand. The invalidity or unenforceability of any provision of the Contract shall not adversely affect the validity or enforceability of the remaining provisions. Neither our failure nor your failure to enforce any term of the Contract constitutes a waiver of such term. Such failure shall in no way affect the right later to enforce such term.
We will not be liable for any loss or damage suffered or incurred by you arising from our delay in fulfilling or failure to fulfil or otherwise discharge any of our obligations under the Contract, to the extent that such delay or failure is caused by any circumstance beyond our reasonable control.
In these terms and conditions:
"Accessory" means any ancillary Product;
“Hardware" means Hardware that is manufactured by or on behalf of Unicare Nz Limited and carries the Super Nanny or juniors trade mark;
"Babies.co.nz Web Site" means our web site for customers in New Zealand located at https://www.babies.co.nz;
“Unicare Nz Warranty" means Unicare Nz Ltd standard hardware warranty, the full terms of which are set out below;
"Condition" means a condition contained in these terms and conditions;
"Contract" means these terms and conditions together with your Order;
"Hardware" means any Product;
"Invoice" means the invoice issued by us to you showing the price of the Products and which your proof of purchase is;
"Order" means an order placed by you in accordance with these terms and conditions;
"Order Confirmation" means the order confirmation issued by us to you indicating acceptance of your Order;
"Order Form" means the electronic order form on the Babies.co.nz Web Site;
"Product" means any product listed on the Babies.co.nz Store Web Site which we agree to supply to you on these terms and conditions;
"Return Materials Authorization Form" means the form issued by us to you for the return of Products;
"Services" means any services relating to Products (including without limitation warranty and telephone support services) that we agree to supply to you on these terms and conditions;
"Web Order Number" means the order number issued by us to you;
"Working Day" means any day other than a Saturday, a Sunday or a public holiday in New Zealand.
